Judge Neil Candelaria listings to the closing arguments.
Defense lawyers did not immediately comment after the ruling by Candelaria.
Seven police officers around the country have faced murder charges for on-duty incidents since 2010.
Two police officers responded to a 911 call in March 2014 that ended in the killing of James Boyd, 38, a homeless man camping in the foothills outside Albuquerque, N.M. Perez and Sandy will be arraigned on charges of second-degree murder, voluntary manslaughter, aggravated assault and aggravated battery, KOAT reports. “It was not Mr. Boyd who came at them”.
A U.S. District judge approved an agreement in June between the city of Albuquerque and Justice Department outlining police department reforms, including additional behavioral health training for officers, creating review boards and bringing in outside agencies to help investigate officer-involved shootings.
“Counsel, having considered all the evidence in the case and applying the standard of probable cause…” Police ended up in a four-hour standoff with Boyd after they attempted to confront him for illegal camping.
Prosecutors charged the two officers with an open count of murder in January.
Defense attorney Sam Bregman, left, questions Albuquerque K-9… The video shows Boyd speaking to police officers in a mild manner some 30 feet away, then bends over to gather his belongings and appears to be ready to follow the officers. Candelaria replied, “What a reasonable police officer in that situation would do”. Jim Fox praised Perez for being “very calm under fire [!]” and said that, “he made great decisions”. “What is it that (Sandy and Perez) were supposed to do?”
Stone could give no explanation for the fact that neither Sandy nor detective Richard Ingram, who fired the Taser shot, ever produced lapel cam videos. McGinn said the city’s police have become too aggressive since then. Since they could not subdue Boyd with “less lethal” means, they were eventually forced to shoot him. Sgt.
The officers went to the scene after calls that Boyd was disturbing people.
After the indictment by Brandenburg on the two officers, her office and the Albuquerque Police Department have had a strained relationship.
The shooting of the 38-year-old Boyd, who police say suffered from mental illness, sparked angry protests in Albuquerque.
Holding fake knives, Bregman asked if Boyd’s position and his actions put officers in danger.
Note: This is a breaking news story and will be updated throughout the day. Authorities say he had schizophrenia.
With nightfall approaching and after making little progress with Boyd, Weimerskirch said, he came up with a plan to get Boyd into custody.
